4.2.3 Temporary transfer
The maximum that a Participant may hold by Temporary transfer is 20% of the Fleet allocation.
4.2.4 Number of traps
When the ITQ of a Participant reaches 12.5% per Permanent transfer, he or she can use 50% more traps than the regular number of traps authorized in the current Management plan. When the ITQ of a Participant reaches 20% of the overall quota of Area 12A, he or she may use twice the number of traps normally authorized in the current Management plan.
Adjustment of the number of traps is effective for the next Management year.

5.2.4 Number of traps
Once a Participant reaches 20% of the overall quota for Area 12B by Permanent transfer, he or she may use 50% more traps with respect to the regular number of traps authorized under the Management plan in force.

6.2.1 Base quota
ITQ corresponding to the % obtained during the implementation of the Program.

Area 12C Group B (New Access) - Each Area 12C Group B snow crab licence holder holds 2.6315% of the quota allocated to Area 12C Group B.

Area 15 Group B (New Access) - Each Area 15 Group B snow crab licence holder holds 4.166% of the quota allocated to Group B.
6.2.2 Maximum ITQ
A Participant may hold a maximum of 7.895% of the Area 12C Group B snow crab quota or 12.498% of the Area 15 Group B snow crab quota or a combination of quota in both areas totalling a maximum of three base ITQs (i.e. a maximum of three base ITQs in either the Area 12C Group B or Area 15 Group B).
6.2.3 Minimum ITQ
The minimum ITQ level of snow crab that a Participant can hold shall be equal to 2.6315% of the snow crab quota in Area 12C Group B or 4.166% of the snow crab quota in Area 1, Group B.
6.2.4 Temporary transfer
A Participant may hold by Temporary transfer a maximum of six (6) base ITQs for snow crab in Area 12C Group B and Area 15 Group B (New Access). The six (6) base ITQs may be held in a single area or a combination thereof as shown in Table 1:

Any Permanent transfer of an ITQ that is less than or equal to 100% will be combined with a Permanent transfer of a number of traps calculated pro rata of said transfer. For this, the number of reference traps is 75 standard traps for an ITQ of 4.762%.
Adjustment of the number of traps is effective for the next Management year.
7.2.4 Temporary transfer
A Participant may hold by Temporary transfer a maximum of 4.762% more than his or her initial ITQ.

10.2.2 Minimum ITQ
The minimum ITQ for this Program is 5% of the Area 16 snow crab TAC allocated to the crab fleet of Groups B and C.
10.2.3 Number of traps
Any Permanent transfer of an ITQ that is less than or equal to 100% will be combined with a permanent transfer of a number of traps calculated pro rata of said transfer. For this, the number of reference traps is 35 traps for an ITQ of 5%.
Adjustment of the number of traps is effective for the next Management year.
10.2.4 Temporary transfer
A Participant may hold, by Temporary transfer, a maximum of 15% of the Area 16 snow crab TAC allocated to the crab fleet of Groups B and C.

12.2.3 Communal licence
A Participant holding a communal licence may not permanently transfer his or her ITQ in whole or in part to another participant. He or she may, however, acquire an ITQ or a portion of an ITQ pursuant to article 12.2.1.
12.2.4 Number of traps
Any Permanent transfer of an ITQ will be combined with a permanent transfer of a number of traps calculated pro rata of said transfer. For this, the number of reference traps is 85 traps.
Adjustment of the number of traps is effective for the next Management year.
12.2.5 Temporary transfer

14.2.1 Maximum ITQ

17.2 Specific clauses for the Program 17 fleet
17.2.1 Maximum ITQ
The maximum ITQ for this Program is 25% for 4RST Greenland halibut, 16.5% for 4RST Atlantic halibut and 16.5% for 3Pn4RS cod.
17.2.2 Minimum ITQ
The minimum ITQ for this Program is 3.8470% for 4RST Atlantic halibut, 2.7273% for 4RST Greenland halibut and 5.2631% for 3Pn4RS cod.
17.2.3 Temporary transfer
17.2.3.1 Including Temporary transfers, the ITQ of a Participant may not exceed 25% of the Fleet allocation for all three species.
17.2.3.2 The ITQs for a Participant who did not participate in the groundfish fishery between May 15 and April 20 are required to be redistributed “at a low price.” Low cost is set at 100% of DFO’s ITQ rates for the fisher who is transferring and at 110% for the fisher who is receiving the transfer. The Association des Crabiers Gaspésiens and the Association de Capitaines Propriétaires de la Gaspésie (ACPG) are responsible for the fair and transparent management of the redistribution of these allocations, and they will use the 10% cost difference to cover administrative expenses related to said management. This redistributed allocation is not transferable, cannot be used to cover quota overage, and must be fished before May 15 in accordance with management plans. Vessel rentals and replacements are not authorized for fishing this allocation.

18.2 Specific clauses for the Program 18 fleet
18.2.1 Maximum ITQ
The maximum ITQ is 12% of the allocation for the fleet under ITQ for each of the three species/stocks.
18.2.2 Minimum ITQ
The minimum ITQ for this Program is 3.51% for 3Pn4RS cod, 3.23% for 4T cod and 2.96% for 4RST Atlantic halibut.
18.2.3 Temporary transfer
18.2.3.1 When the TAC for 3Pn4RS cod, 4T cod and 4RST halibut is less than 2,000 t, 2,000 t and 350 t, respectively, a participant may temporarily transfer to another Participant a maximum of 100% of his or her initial ITQ without having had to make the previous year’s landings. However, he or she must have a sufficient allocation to cover the cod and halibut bycatches; i.e. the limits in the Conservation Harvesting Plan, unless they did not participate in any groundfish fishery.
18.2.3.2 Including Temporary transfers, a Participant may not hold more than 15% of the fleet allocation for all three species.
18.2.3.3 The cod ITQs for a longliner who did not participate in the groundfish fishery between May 15 and August 31 are redistributed “at a low cost” as of September 1. In the case of halibut, the ITQs for a longliner who did not participate in the groundfish fishery between May 15 and April 25 are required to be redistributed “at a low cost” as of May 1. Low cost is set at 100% of DFO’s ITQ rates for the fisher who is transferring and at 110% for the fisher who is receiving the transfer. 19.2 Specific clauses for the Program 19 fleet
19.2.1 Minimum ITQ
The minimum ITQ for this Program is 0.9019% of the Fleet allocation.
19.2.2 Maximum ITQ
19.2.2.1 The maximum ITQ for this Program is 4.3634% of the Fleet allocation.
19.2.2.2 A Participant with an ITQ of 0.0060% to 0.9018% of the Fleet allocation:
(i) is not authorized to transfer his or her ITQ, in whole or in part, without reassigning or surrendering the groundfish licence.
(ii) is authorized to permanently acquire, in whole or in part, another Participant’s ITQ, without exceeding 4.3634% of the Fleet allocation
19.2.3 Temporary transfer
19.2.3.1 Including Temporary transfers, the ITQ of a Participant must be equal to or greater than 0.0060% of the Fleet allocation.
19.2.3.2 Including Temporary transfers, the ITQ of a Participant must not exceed 5.4915% of the Fleet allocation.
19.2.3.3 The Greenland Halibut ITQ of a participant who did not participate in groundfish fishery between May 15 and a cut-off date determined annually by the Committee is redistributed “at a low price.” The low price is that set at 100% of DFO’s ITQ costs for the fishers who are transferring, and at 110% for those who are receiving. The Office des pêcheurs de flétan du Groenland du Québec (OPFGQ) is responsible for and must approve the fair and transparent management of the redistribution of these allocations, and it will use the 10% cost difference to cover administrative expenses related to said management. This redistributed allocation is not transferable, cannot be used to cover quota overage and must be fished before May 15 in accordance with management plans. Boat leasing and fish harvester replacement are not authorized for fishing this allocation.

20.2.1 Maximum ITQ

20.2.2 Minimum ITQ
The minimum ITQ for this Program is 0.641% of the Fleet allocation.
20.2.3 A Participant with an ITQ of less than 0.641%, of the Fleet allocation:
20.2.3.1 is authorized to permanently acquire, in whole or in part, another participant’s ITQ, without exceeding 5.766% of the fleet allocation under ITQ;
20.2.3.2 is not authorized to transfer his or her ITQ, in whole or in part, without leaving the ITQ program by ceasing to fish for Greenland halibut and by transferring 125 kg (275 lb) to the quota for the regime outside of the Program.
20.2.4 Temporary transfer
20.2.4.1 Including temporary transfers, a Participant must not exceed 7.047% of the Fleet allocation.
20.2.4.2 The Greenland Halibut ITQ of a participant who did not participate in groundfish fishery between May 15 and a cut-off date determined annually by the Committee is redistributed “at a low price.” The low cost is set at 100% of DFO’s ITQ rates for the fisher who is transferring and at 110% for the fisher who is receiving the transfer. The Association des pêcheurs de la Basse-Côte-Nord is responsible for and must approve the fair and transparent management of the redistribution of these allocations, and it will use the 10% cost difference to cover administrative expenses related to said management. This redistributed allocation is not transferable, cannot be used to cover quota overage, and must be fished before May 15 in accordance with management plans. Vessel rentals and replacements are not authorized to fish this allocation.

The maximum ITQ for this Program is:

- 2,8640% of the 4RST Atlantic Halibut Fleet Allocation.
22.2.2 Minimum ITQ
The minimum ITQ for this Program is:
- 0,1852% for levels 1, 2 and 3 of the Fleet Allocation for 3Pn4RS cod;
- 0,1909% of the 4RST Atlantic Halibut Fleet Allocation;
22.2.3 Temporary transfer
22.2.3.1 Including temporary transfers, a Participant may not exceed 2.9648%, 2.9644% and 2.9648% respectively for levels 1, 2 and 3 of the Fleet Allocation for 3Pn4RS cod.
